Welcome to BloomFolk Living! The terms 'we', 'us' and 'our' refer to BloomFolk Living. BloomFolk Living manages this shop and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a personalised shopping experience (the 'Services'). BloomFolk Living is powered by Shopify, which enables us to deliver the Services to you.
The terms and conditions below, together with any policies referred to herein (these 'Terms of Service' or 'Terms'), describe your rights and responsibilities when using the Services.
Please read these Terms of Service carefully, as they contain important information about your legal rights and address areas such as disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, please do not use or access our Services.
Section 1 — Access and account
By agreeing to these Terms of Service, you confirm that you are at least the age of majority in the state or province in which you reside.
To use the Services, including browsing our shop or purchasing products, you may be asked to provide certain information such as your email address, billing address, delivery address and payment details. You represent and warrant that all information you provide is accurate, current and complete and that you have all rights necessary to provide it.
You are solely responsible for the security of your account login details and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.
Section 2 — Our products
All BloomFolk Living products are made to order and personalised for each customer. We have made every effort to represent our products accurately. Please be aware that colours and appearance may vary depending on the device you use to access the shop and its settings.
We do not guarantee that the appearance or quality of any product you purchase will meet your expectations or be identical to what is depicted in our shop. Product descriptions may be changed at any time without notice at our sole discretion.
We reserve the right to discontinue any product at any time and may limit the quantities of products we offer to any person, geographic region or jurisdiction.
Section 3 — Orders
When you place an order, you are making an offer to purchase. BloomFolk Living reserves the right to accept or decline your order for any reason at its sole discretion. Your order is only accepted once BloomFolk Living has confirmed acceptance. We must receive and process your payment before your order is accepted.
Because all products are made to order and personalised, please check your order carefully before submitting it. BloomFolk Living may not be able to process cancellation requests once an order has been accepted and sent to production.
Returns and refunds are handled in accordance with our Returns & Refunds policy. As all products are personalised and made to order, we are unable to accept returns or exchanges except in the case of damaged, defective or incorrect items. If your order arrives damaged or defective, please contact us within 14 days of receipt at contact@bloomfolkliving.com with photos of the packaging and the damage or defect. We will offer you the choice of a full refund or a free reprint.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Section 4 — Pricing and billing
Prices, discounts and promotions may change without notice. The price charged for a product is the price in effect at the time the order is placed and will be stated in your order confirmation email. Unless expressly stated otherwise, prices shown are exclusive of taxes, shipping and handling charges, and customs or import duties.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made in our shop. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you if necessary.
Section 5 — Shipping and delivery
All BloomFolk Living products are fulfilled by our print partner in the USA. Production typically takes 2–7 business days, after which delivery times apply as set out on our Shipping & Delivery page.
We are not liable for delays in shipping and delivery. All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events beyond our control. Once products are handed to the carrier, title and risk of loss pass to you. Orders shipped outside the USA may be subject to customs fees or import duties, which are the responsibility of the recipient.
Section 6 — Intellectual property
Our Services, including but not limited to all designs, illustrations, text, images, graphics, trademarks and logos, are the property of BloomFolk Living or its licensors and are protected by applicable intellectual property laws. All original designs used on BloomFolk Living products are created by us and may not be reproduced, copied or used commercially without our prior written consent.
These Terms permit you to use the Services solely for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent.
The BloomFolk Living name, logo, product and service names, designs and slogans are trademarks of BloomFolk Living. You may not use such trademarks without our prior written consent. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify.
Section 7 — Optional tools
You may have access to third-party tools offered as part of the Services over which we have no control. Such tools are provided 'as is' and 'as available' without warranties of any kind. We have no liability arising from your use of optional third-party tools. Any use of optional tools is entirely at your own risk.
Section 8 — Third-party links
The Services may contain links to third-party websites or platforms. We are not responsible for examining or evaluating the content or accuracy of third-party websites. If you choose to access such sites, you do so at your own risk. We are not liable for any harm or damage in connection with your use of third-party websites or any products or services purchased through them.
Section 9 — Relationship with Shopify
BloomFolk Living is powered by Shopify, which enables us to deliver the Services to you. All sales and purchases you make in our shop are made directly with BloomFolk Living. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of a sale between you and BloomFolk Living, including injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with BloomFolk Living.
Section 10 — Privacy policy
All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read our Privacy Policy.
Section 11 — Feedback
If you submit, upload, post or otherwise send us ideas, suggestions, feedback, reviews or other content ('Feedback'), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including commercial use. You represent and warrant that you own or have all necessary rights to all Feedback you submit, and that your Feedback complies with these Terms. We are not obliged to treat your Feedback as confidential, pay compensation for it or respond to it.
Section 12 — Errors, inaccuracies and omissions
Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping costs, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information is incorrect, at any time without prior notice.
Section 13 — Prohibited uses
You may only visit and use the Services for lawful purposes. You may not use the Services (a) for unlawful or malicious purposes; (b) in violation of any applicable laws or regulations; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame or intimidate others; (e) to send false or misleading information; (f) to send or upload material that does not comply with these Terms; (g) to send unsolicited advertising or promotional material including spam or chain letters; (h) to impersonate any person or entity; or (i) to restrict or inhibit anyone's use of the Services.
You also agree not to upload or transmit viruses or malicious code, reproduce or exploit any part of the Services, collect other users' personal information, spam or phish, or use automated tools or AI agents to access the Services without our consent.
We reserve the right to suspend, disable or terminate your account at any time without notice if we determine that you have violated any part of these Terms.
Section 14 — Agents
If you use or permit the use of any software or service that acts autonomously or semi-autonomously on your behalf ('Agent') to access or interact with the Services, such Agent must at all times identify itself and comply with our technical requirements. Agents may not conceal or obscure that they are automated, impersonate human behaviour, bypass CAPTCHA or security measures, or circumvent restrictions we put in place to control access to the Services.
Section 15 — Termination
We may terminate this agreement or your access to the Services at any time at our sole discretion and without prior notice. You will remain liable for all amounts due up to and including the date of termination. Provisions that by their nature should survive termination will continue to apply.
Section 16 — Disclaimer of warranties
The Services and all products offered through the Services are provided 'as is' and 'as available' without any representations, warranties or conditions of any kind, whether express or implied, including all implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. We do not warrant that your use of the Services will be uninterrupted, timely, secure or error-free. Nothing in these Terms limits or excludes any statutory rights you may have as a consumer under applicable law.
Section 17 — Limitation of liability
To the extent permitted by law, BloomFolk Living, our partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors shall not be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind arising from your use of the Services or any products purchased through the Services. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded under applicable law.
Section 18 — Indemnification
You agree to indemnify, defend and hold harmless BloomFolk Living, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from all losses, damages, liabilities or claims, including reasonable legal fees, arising from (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
Section 19 — Severability
If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable part shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.
Section 20 — Waiver; entire agreement
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms of Service, together with any policies or rules posted by us on the Services, constitute the entire agreement between you and us with respect to your use of the Services.
Section 21 — Assignment
You may not delegate, transfer or assign this agreement or your rights or obligations under these Terms without our prior written consent, and any such attempt will be void. We may transfer, assign or delegate these Terms and our rights and obligations without consent or notice to you.
Section 22 — Governing law
BloomFolk Living is based in the Netherlands and these Terms of Service are governed by the laws of the Netherlands. Disputes shall be subject to the jurisdiction of the competent courts of the Netherlands.
If you are a consumer based in the United States, please note that our products are printed and fulfilled by a US-based print partner (Printify) and shipped from within the United States. Your order is subject to applicable US federal and state consumer protection laws in addition to these Terms. Nothing in these Terms limits any rights you may have under the consumer protection laws of your state.
If you are a consumer based in the European Union, your statutory rights under EU consumer law, including the Consumer Rights Directive, are not affected by these Terms.
Section 23 — Changes to the Terms of Service
You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates on our website. We will notify you of significant changes in accordance with applicable law. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes.
